Terms of Service

These Terms of Service (the Terms) govern access to and use of the Yachtara website, web application, mobile applications, community features and related services (together, the Service).

Please read these Terms before creating an account or purchasing a subscription. By creating an account, starting a trial, purchasing a subscription or otherwise accepting these Terms, you enter into a contract with AD Internet Consulting BV. If you do not agree, do not use the Service.

1. Service provider

The Service is provided by:

2. Eligibility and authority

You must be at least 18 years old and legally capable of entering into a binding contract to create an account or purchase a subscription.

If you use the Service for a company, fleet, charter operator or other organisation, you confirm that you are authorised to bind that organisation. References to you then include that organisation where appropriate. Mandatory consumer rights apply only where you qualify as a consumer under applicable law.

The Service may not be available in every country. You are responsible for ensuring that your use is lawful where you are located and that you are not subject to applicable trade, export-control or sanctions restrictions.

3. What Yachtara provides

Yachtara brings boat-management and passage-planning functions together in one service. Depending on the selected plan and the features currently released, these may include:

  • vessel and owner records;
  • maintenance tasks, service history and incident records;
  • manuals and document storage;
  • crew invitations, access and watch schedules;
  • weather information and comparison of forecast models;
  • route planning based on forecast data, currents and vessel performance information supplied by the user;
  • an on-device anchor-watch function;
  • community boards, posts and user-published location information; and
  • offline-ready packages and locally stored information.

Features marked coming soon, planned, development, beta or similar are not part of the current Service and are not promised for a particular date. In particular, telemetry, NMEA ingestion and AI boat intelligence are not current production features unless Yachtara expressly announces their release.

4. Accounts

You must provide accurate information, keep it reasonably current and protect your credentials. Do not share credentials or allow unauthorised access. Tell us promptly at support@yachtara.com if you suspect that an account has been compromised.

You are responsible for activity performed through your account unless it results from a security failure for which Yachtara is legally responsible.

We may require email verification, re-authentication or other proportionate checks to protect an account, process a rights request or prevent fraud.

5. Vessel workspaces, owners and crew

A vessel owner or authorised administrator can invite other people to a vessel workspace and assign permissions. An invitation may require Yachtara to process the invitee's email address before that person creates an account. Only invite people whom you are entitled to contact for the relevant vessel or activity.

The vessel owner or administrator controls workspace membership and may remove access. Members may be able to view or edit vessel records, documents, maintenance information, schedules and other shared material according to their assigned role. Do not place information in a shared vessel workspace unless it is appropriate for all authorised members who can access it.

Disputes between owners, skippers, crew, employers, charter companies or former members about a vessel, records or permissions are primarily disputes between those parties. Yachtara may preserve access, restrict changes or request evidence while a credible ownership or authority dispute is investigated, but Yachtara does not determine title to a vessel or employment rights.

6. Plans, trials and subscriptions

6.1 Plans

Yachtara may offer a Free plan and paid plans such as Essential and Premium. A future AI plan may be displayed before its AI features are available; displaying a roadmap tier does not mean those features have shipped.

The current price, billing period, included features, storage allowance, applicable taxes and renewal terms are shown before checkout. Consumer prices are displayed inclusive of VAT and other unavoidable charges where required by law. Business prices may be shown exclusive of VAT if clearly identified as such.

6.2 Seven-day trial

Where offered, a paid plan begins with a seven-day free trial. The checkout page will state the date and amount of the first charge and the recurring billing period. Unless you cancel before the trial ends, the subscription automatically converts to a paid subscription.

Starting a trial may require a valid payment method. Yachtara does not receive or store your full card number, security code or card expiry date; payment details are entered on Stripe-hosted pages and handled by Stripe.

6.3 Automatic renewal

Paid subscriptions renew automatically on a quarterly or annual basis, as selected at checkout, until cancelled. Stripe charges the payment method associated with the subscription at the start of each renewal period.

We will provide the legally required pre-contract information and an order confirmation on a durable medium, normally by email. We intend to send a reminder before the first trial conversion and before an annual renewal. A failure to receive a non-mandatory reminder does not itself cancel a subscription, but it does not affect rights granted by mandatory law.

6.4 Cancellation

You can cancel a paid subscription through the account or Stripe customer portal. Cancellation stops future renewal. Unless applicable law, the withdrawal section below or a stated refund policy provides otherwise, access continues until the end of the paid period and unused time is not refunded.

Deleting the Yachtara application does not cancel a subscription. Deleting an account while a paid subscription remains active may not automatically stop Stripe billing. Cancel the subscription first or contact support and ask us to do both.

6.5 Failed payments and downgrade

If a renewal payment fails, Yachtara may allow a seven-day grace period. If payment is not completed during that period, the account may be downgraded to a lower plan and paid features may become unavailable.

If stored material exceeds the allowance of the lower plan, Yachtara may restrict new uploads or changes. We will not intentionally delete stored customer material solely because of a downgrade without reasonable advance notice and a reasonable opportunity to export or reduce it, except where immediate action is required for security, law or abuse prevention.

6.6 Price and plan changes

We may change prices or plan content prospectively. A price increase or material adverse change to a paid subscription takes effect no earlier than the next renewal after reasonable advance notice. You may cancel before it takes effect. Changes required for security, law, safety or continued technical operation may take effect sooner where reasonably necessary.

7. Consumer withdrawal rights

If you are an EU or EEA consumer and the statutory withdrawal right applies to your contract, you normally have 14 calendar days from the conclusion of the distance service contract to withdraw without giving a reason. For a trial subscription, that period starts when you enter into the subscription at the beginning of the trial, not when the first payment is taken.

The seven-day trial is free. EU/EEA consumers request immediate access when starting it. If Yachtara has charged the initial subscription payment before receiving a valid EU/EEA withdrawal within the first 14 days, Yachtara will refund that initial charge using the original payment method, subject to mandatory law. Yachtara does not voluntarily extend the EU/EEA 14-day withdrawal right to consumers outside the EU/EEA. If you are a consumer elsewhere, you have only the cancellation, cooling-off, withdrawal and refund rights that applicable mandatory law grants you. Any such right applies with the scope, deadline, procedure and remedy required by that law. If no such mandatory right applies, ordinary cancellation stops a future renewal but does not refund the current paid period.

Withdrawal is different from ordinary cancellation. Withdrawal ends the initial contract and may entitle you to a refund. Ordinary cancellation stops a future renewal.

Nothing in these Terms, the country selected at checkout or the checkout workflow restricts mandatory rights relating to digital services, unfair terms, non-conformity, cooling-off, refunds or cancellation under the law applicable to you.

8. Your content and records

You retain ownership of content you upload or create, including vessel information, maintenance records, manuals, photographs, forum contributions and route information (User Content).

You grant Yachtara a non-exclusive, worldwide, royalty-free licence to host, reproduce, process, transmit, back up and display User Content only as reasonably necessary to provide, secure and improve the Service, comply with law, enforce these Terms, and carry out actions you request. This licence ends when the relevant content is deleted from active systems, subject to backups, legal retention and public community content handled as described below.

You confirm that you have the necessary rights and permissions for User Content and that its use through the Service does not infringe another person's rights, confidentiality or applicable law.

Do not upload highly sensitive documents unless they are genuinely necessary for operating the vessel. Yachtara is not intended to store passports, national identity cards, payment-card data, medical files or government security credentials.

9. Community content

Community posts are public or visible to the audience shown in the interface. Do not publish information that you expect to remain private. Location-board posts may include coordinates deliberately selected by the user and stored at reduced precision of approximately three decimal places, or roughly 111 metres at the equator.

The Acceptable Use and Community Guidelines form part of these Terms. They explain prohibited content, reporting, moderation and appeals.

By publishing community content, you grant Yachtara the limited licence necessary to display, distribute, format and moderate it within the Service. Other users may view and quote public contributions as the community functionality permits. This does not transfer ownership to Yachtara.

When an account is erased, Yachtara may delete community content or retain it with the author identity removed or replaced by a neutral label where this is lawful and necessary to preserve discussions. You should delete individual posts before requesting account erasure if you want them removed, subject to lawful retention for complaints, evidence or legal obligations.

10. Acceptable use

You must not:

  • use the Service unlawfully, fraudulently or to facilitate harm;
  • upload malware or attempt to bypass, probe or disrupt security;
  • scrape, crawl, bulk-download or reverse engineer the Service except where applicable law expressly permits it;
  • interfere with capacity, rate limits, access controls or another user's account;
  • upload content that infringes intellectual property, privacy, confidentiality or personality rights;
  • harass, threaten, impersonate or unlawfully discriminate against another person;
  • publish dangerously misleading marine-safety information as fact;
  • use the Service to track a person or vessel without a lawful basis and appropriate authority;
  • resell, sublicense or commercially exploit the consumer Service without written permission; or
  • use the Service in connection with prohibited weapons, sanctioned parties or unlawful maritime activity.

Reasonable security research must be authorised in writing before testing production systems.

11. Marine safety - essential limitations

Yachtara is a supplementary planning, organisation and awareness tool. It is not a certified navigation system, electronic chart display and information system, collision-avoidance system, emergency service or substitute for competent seamanship.

Weather, current, radar, routing, map and coastline information may be delayed, incomplete, unavailable, incorrectly interpreted or affected by third-party data and model uncertainty. A computed route does not establish that the route is navigable, sufficiently deep, free of hazards, legally permitted or suitable for the vessel, skipper or conditions.

You must independently use current official nautical charts and publications, Notices to Mariners, official forecasts and warnings, local regulations, visual and instrument observations, proper watchkeeping, safe margins, and the judgement of a competent skipper.

Anchor watch is an on-device aid. It depends on device power, GPS quality, operating-system permissions, volume and notification settings, background execution and correct setup. It is not remotely monitored by Yachtara and does not contact rescue services. Maintain a proper anchor watch appropriate to the circumstances.

Yachtara is not a GMDSS service, EPIRB, PLB, AIS transponder, VHF radio or distress beacon. In an emergency, use recognised maritime distress procedures and equipment.

The skipper and vessel operator remain responsible for the vessel, passage, navigation, crew and compliance with law. More detail appears in the Navigation and Safety Notice.

12. Third-party services and data

The Service may rely on or link to third-party services, including weather-data sources, map and tile providers, app stores, payment services and external websites. Those services may have their own terms, licences and privacy notices.

Yachtara does not control third-party data production or availability. Attribution does not mean that a data provider endorses Yachtara, and providers are not responsible for Yachtara's interpretation or use of their information.

Apple and Google provide distribution platforms, not the Yachtara subscription contract, unless a store checkout expressly states otherwise. Stripe handles payment services under its own terms and privacy notice.

13. Availability, offline use and beta features

We aim to provide a reliable Service but do not promise uninterrupted or error-free operation. Connectivity, device compatibility, operating-system restrictions, scheduled maintenance, third-party outages and maritime conditions can affect availability.

Offline packages can become stale. Reconnect and refresh data before relying on it for a new passage. Offline availability does not guarantee that every function or data layer works without a connection.

Early-access or beta features may be incomplete, change materially or be withdrawn. We will label them and will not knowingly represent future functionality as already available.

14. Updates and conformity

We may provide functional and security updates. Install updates within a reasonable time, especially where we explain that an update is necessary for security or conformity.

For consumers, Yachtara remains responsible for supplying the digital service in conformity with the contract and for remedies required by applicable law. Nothing in these Terms removes the Belgian and EU legal guarantee for digital content and digital services or equivalent mandatory rights elsewhere.

We may modify the Service beyond what is necessary to maintain conformity only where the contract and applicable law permit it, there is a valid reason, no additional cost is imposed solely for the modification, and users receive legally required information and termination rights.

15. Suspension and termination

You may stop using the Service and request account deletion at any time, subject to subscription cancellation and lawful retention.

We may restrict content, suspend features or terminate an account where reasonably necessary because of:

  • a material or repeated breach of these Terms;
  • illegal content or activity;
  • a security threat, fraud or abuse;
  • non-payment after the applicable grace period;
  • a legal or regulatory requirement; or
  • conduct creating a serious risk to users, Yachtara or third parties.

Except where urgent action is necessary, we will provide reasonable notice and an opportunity to correct the issue. For content moderation, we will provide reasons and an appeal route where required by law.

On termination, access ends as stated in the notice. We will provide a reasonable opportunity to export account content where technically feasible and legally appropriate. Provisions that by their nature should survive - including ownership, payment obligations, liability limits, dispute provisions and lawful retention - continue to apply.

16. Warranties and mandatory rights

The Service is provided with the level of care and conformity required by applicable law. Descriptions of released plan features form part of the contract where the law says they do.

No statement in these Terms excludes a warranty, guarantee or remedy that cannot lawfully be excluded. Subject to that rule, Yachtara does not guarantee that third-party forecasts, maps, community content, user-entered vessel information or route outputs are accurate or suitable for a particular voyage.

17. Liability

Nothing in these Terms excludes or limits liability where doing so would be unlawful, including liability for fraud or intentional misconduct, or mandatory liability for death, personal injury, consumer rights or non-conforming digital services.

17.1 Consumers

If you are a consumer, Yachtara is responsible for loss that is a foreseeable result of Yachtara's breach of contract or failure to use legally required care. Yachtara is not responsible for loss caused by inaccurate information supplied by you, failure to follow clear safety instructions, use contrary to these Terms, an event outside reasonable control, or a third-party service for which Yachtara is not legally responsible.

Yachtara is not liable to a consumer for business losses arising from consumer use, including lost profit, revenue, charter income or commercial opportunity.

17.2 Business users

If you use the Service for business purposes, to the maximum extent permitted by law:

  • neither party is liable for indirect or consequential loss, lost profit, lost revenue, lost opportunity or loss of anticipated savings;
  • Yachtara's aggregate contractual liability for the event or connected series of events is limited to the fees paid or payable for the affected Service during the 12 months before the event; and
  • the limitation does not apply to liability that cannot lawfully be limited, breach of confidentiality, infringement caused by Yachtara, or payment obligations.

Business fleet, charter, integration or high-volume use may require a separate written agreement with different service levels, insurance and liability allocation.

18. Privacy

The Privacy and Data Protection Notice explains how Yachtara handles personal data. The Cookie and Similar Technologies Notice explains website and application storage technologies.

Privacy consent, where legally required, is separate from acceptance of these Terms. Accepting the Terms does not constitute consent to marketing or optional tracking.

19. Changes to these Terms

We may update these Terms for legal, security, technical or commercial reasons. We will identify the revision date.

For material changes affecting an existing paid subscription, we will give reasonable advance notice on a durable medium. The change will take effect as stated in the notice, normally at the next renewal, unless earlier effect is necessary by law or for urgent security reasons. Where required, you may reject the change and terminate without penalty.

Mere continued use will not be treated as acceptance of a material adverse change where applicable law requires express agreement.

20. Governing law and disputes

Belgian law governs these Terms.

If you are a consumer, this choice does not deprive you of mandatory protection under the law of your habitual residence. You may bring proceedings in any court available under mandatory consumer-jurisdiction rules. Yachtara may bring proceedings against an EU consumer only in the courts of that consumer's domicile, except where mandatory law permits otherwise.

The former EU Online Dispute Resolution platform was discontinued on 20 July 2025 and is therefore not referenced as an active complaint channel.

For business users, the courts of the judicial district in which AD Internet Consulting BV has its registered office have exclusive jurisdiction, subject to Yachtara's right to seek urgent or protective relief elsewhere.

21. General provisions

If a provision is invalid or unenforceable, it will be limited to the minimum extent necessary and the remainder will continue. A failure to enforce a provision is not a waiver. You may not transfer the contract without consent, except where mandatory law allows. Yachtara may transfer it as part of a merger, restructuring or sale of the relevant business, provided this does not reduce mandatory consumer rights.

These Terms, the plan description at checkout, the Privacy Notice, the Community Guidelines and any expressly incorporated order terms form the agreement for the Service. A separate signed business agreement prevails to the extent of a conflict for the services it covers.
